FAQ
Employment contract questions
- Is a written employment contract required?
- Usually not — most U.S. employment is at-will and doesn’t require a written contract. But a clear written agreement sets expectations on pay, duties, confidentiality and IP, which protects both sides.
- What does “at-will” employment mean?
- At-will means either the employer or the employee can end the relationship at any time, with or without cause. It is the default in most states; a few (such as Montana) have different rules, so this generator adjusts the clause by state.
- Should I pay salary or hourly?
- That depends on the role and on wage-and-hour laws — many roles must be paid hourly with overtime unless they meet an exemption. This tool documents whichever you choose; confirm the classification for the role.
- Can I add a non-compete or non-solicitation clause?
- You can add a non-solicitation clause here, but enforceability varies a lot by state and some states limit or ban these clauses. For non-competes especially, get state-specific legal advice.
- Is this legal advice?
- No. Free Contract Generator provides self-help templates and general information, not legal advice, and no attorney-client relationship is created. Consult a licensed attorney for advice about your specific situation.
