Bill of sale questions
- Is a bill of sale legally binding?
- Yes — once both parties sign it, a bill of sale is a binding record of the sale. Some states or items (like vehicles) also require you to transfer the title and file paperwork with the DMV, so check your state’s rules.
- Do I need to get it notarized?
- Most states don’t require notarization for a bill of sale, but a few do for vehicles. Notarizing is never a bad idea for a high-value item. Check your state and local DMV requirements.
- Does “as-is” protect the seller?
- An as-is clause means the buyer accepts the item in its current condition with no warranties, which limits the seller’s liability for later problems. It does not cover fraud or a false odometer statement.
- Does this transfer the vehicle title?
- No. A bill of sale records the sale, but transferring a vehicle’s title is a separate step you do through your state’s DMV. Bring the signed bill of sale and the title with you.
