Bill of sale questions

Is a bill of sale legally binding?
Yes — once both parties sign it, a bill of sale is a binding record of the sale. Some states or items (like vehicles) also require you to transfer the title and file paperwork with the DMV, so check your state’s rules.
Does a bill of sale need to be notarized?
Usually not, and where a notary is involved it is more often the title assignment than the bill of sale that has the requirement. A few states do require notarization for a vehicle transfer, so check your state and local DMV before either party signs. For a high-value item, notarizing is never a bad idea even where it is not required.
Does “as-is” protect the seller?
An as-is clause means the buyer accepts the item in its current condition with no warranties, which limits the seller’s liability for later problems. It does not cover fraud or a false odometer statement.
Does this transfer the vehicle title?
No. A bill of sale records the sale, but transferring a vehicle’s title is a separate step you do through your state’s DMV. Bring the signed bill of sale and the title with you.
