- Do I need a lawyer to make a contract?
- Not always. For straightforward agreements many people use a self-help template like this one. For complex, high-value or unusual situations, having a licensed attorney review the document is a sensible step.
- Are these real contracts or just samples?

- What makes a contract legally binding?
- Four elements, in most cases: an offer, acceptance of that offer, consideration — each side gives up something of value — and an intention to create a legal relationship. On top of that, the parties have to have the capacity to contract and the purpose has to be lawful. Being written down is not itself one of the requirements for most everyday agreements, but it is what makes the terms provable if anyone disputes them later. Some contracts do have to be in writing under a state’s statute of frauds — sales of land, agreements that cannot be performed within a year, and in many states a promise to answer for someone else’s debt.
