Idaho Bill of Sale — Free Template & Generator

Idaho puts both deadlines on its own bill of sale. On form ITD 3738 the seller signs “I understand that I must file a release of liability statement within five days of delivering the vehicle to the buyer,” and the buyer signs that they “must apply for title within 30 days to avoid a penalty whether the vehicle is registered or not.” Five days for the seller, thirty for the buyer — generate the bill of sale below, then work through the steps cited to the Idaho Transportation Department.

What Idaho actually requires

Idaho rules for a private sale

Last verified September 30, 2026
  • Buyer’s deadline 30 days, or a $20 penalty

For a private party sale with no lienholder, “You must file the following documents with a county assessor’s motor vehicle office within 30 days of transfer to avoid a $20.00 late-filing penalty.” The fee table lists the title fee as $14.00. A used vehicle bought privately needs “the existing title with proper signatures releasing interest from the previous owner or lienholder.”

  • Seller’s release of liability Within 5 days of delivery, $3.50

Form ITD 3858: “According to Section 49-526, Idaho Code, you may also do the following within five (5) days of delivery to the purchaser,” with a $3.50 fee, or file online at DMVonline. Filing “may protect you from liability for death or injury, property damage, motor vehicle infractions, towing, storage, repair or service charges involving the vehicle that may occur after delivery of the vehicle to the purchaser.” The form reminds sellers: “Remove your vehicle license plates upon sale or transfer!”

  • Odometer For vehicles newer than 2010, under 16,000 lbs

The ITD’s document list for a private sale includes an “Odometer Disclosure for vehicles newer than 2010, weighing under 16,000 lbs.” ITD 3738 records the reading in whole miles and whether it is actual, not actual, beyond mechanical limits or exempt.

  • No signed title? A bill of sale can stand in — with extra steps

“In the event that a properly released title cannot be obtained, a Bill of Sale may be used; however, this process requires additional steps.” The ITD points to the Bill of Sale and the Conditional Title Statement of Facts for those steps, and for that route the vehicle must be odometer exempt.

How this document fits Idaho’s paperwork

Official form: ITD 3738 — Bill of Sale (Rev. 10/23). Covers VIN or hull number, title number, brands (rebuilt, salvage, reconstruct…), the odometer reading with actual / not actual / exceeds mechanical limits / exempt, the true selling price and the sale date. The seller certifies the odometer reading; the buyer acknowledges the seller’s brand disclosure.

The signed title transfers the vehicle; the bill of sale records the true selling price, the date and the odometer reading. ITD 3738 is Idaho’s one-page version, and the generated document adds payment and as-is terms. On the day of the sale the seller removes the plates, and within five days files the release of liability online or on ITD 3858 with the $3.50 fee. The buyer has thirty days to file at a county assessor’s motor vehicle office before the $20 penalty applies.

FAQ

Idaho bill of sale questions

Is a bill of sale required in Idaho?
For a normal private sale the title, signed to release the previous owner’s interest, is what the county office needs. Idaho’s own bill of sale, ITD 3738, is where the true selling price, the sale date and the odometer are recorded, and it becomes essential when a properly released title cannot be obtained — then a bill of sale can be used, with the additional steps in the Conditional Title Statement of Facts.
How do I file a release of liability in Idaho?
Within five days of delivering the vehicle, either online at DMVonline or by sending form ITD 3858 with a $3.50 check or money order made payable to the DMV. The form asks for the VIN, the buyer’s name and address, the odometer reading, the selling price and the delivery date. Filing it may protect you from liability for what happens with the vehicle after you hand it over.
What is the Idaho late title penalty?
$20. The buyer must file with a county assessor’s motor vehicle office within 30 days of the transfer to avoid it, whether or not the vehicle is registered.
Does an Idaho bill of sale need to be notarized?
ITD 3738 has signature lines for the seller and the buyer and no notary block. What it does contain is two certifications: the seller certifies the odometer reading, and the buyer acknowledges the seller’s disclosure of any brands on the vehicle.
Do I keep my license plates when I sell a car in Idaho?
Remove them. The ITD’s release of liability form tells sellers to remove their vehicle license plates upon sale or transfer.
