Texas rules landlords must follow

  • Security deposit cap No statutory cap

    Texas does not set a maximum security deposit by statute — the amount is set by the lease. Charge a reasonable amount; an excessive deposit can be hard to justify.

  • Deposit return deadline 30 days

    The landlord must refund the deposit on or before the 30th day after the tenant surrenders the premises, with an itemized list of any deductions.

  • Ending a month-to-month tenancy At least one month

    Either party may end a month-to-month tenancy with notice; it terminates on the later of the day stated in the notice or one month after the day notice is given.

  • Notice to enter No statutory notice

    Texas has no general statute requiring a landlord to give advance notice before entering — what the lease says controls, so spell out entry rights and notice in the lease.

Required disclosures

Lead-based paint (federal)
For any housing built before 1978, federal law requires the landlord to disclose known lead-based paint and hazards, give the EPA pamphlet “Protect Your Family From Lead in Your Home,” and include a lead warning in the lease. 42 U.S.C. § 4852d; 24 CFR Part 35 / 40 CFR Part 745
Owner / manager identity
The lease (or other written notice) must disclose the name and address of the property owner or the person authorized to manage the premises and act for the owner. Tex. Prop. Code § 92.201
